Intellectual Property Rights & Marketplace Protection

Omnity Center respects intellectual property rights and expects customers, vendors and other users of the marketplace to do the same. This policy explains the use of Omnity Center content, seller content, trademarks, copyrighted material and the process for reporting suspected intellectual property infringement.

Counterfeit and infringing products are not permitted.

Vendors must ensure that products, images, brand names, descriptions, logos and other material used in their listings are genuine, authorized where required, and do not unlawfully infringe the rights of another person or organization.

Purpose & Scope

This policy applies to intellectual property matters associated with the Omnity Center website, marketplace, product listings, vendor stores, marketing material and other marketplace content.

Omnity Center Content

Content created or lawfully owned by Omnity Center may include website designs, original graphics, written material, marketplace content, branding and other proprietary material.

Such material may be protected by applicable intellectual property laws.

Omnity Center Brand & Trademarks

The Omnity Center name, logo, branding and other distinctive brand elements must not be used in a way that falsely suggests ownership, endorsement, partnership or authorization.

  • Do not copy or imitate the Omnity Center logo without authorization.
  • Do not create misleading websites, pages or accounts using our brand identity.
  • Do not represent yourself as Omnity Center without authorization.
  • Do not use Omnity Center branding to mislead customers or vendors.

Permitted Website Use

Users may access and use the website for legitimate personal, shopping, vendor or marketplace purposes.

Normal use of the website does not transfer ownership of any intellectual property rights to the user.

Unauthorized Use

Unless legally permitted or authorized, users must not reproduce, commercially exploit or falsely claim ownership of protected Omnity Center material.

  • Unauthorized commercial copying.
  • Misleading reproduction of branding.
  • Unauthorized redistribution of proprietary material.
  • Removal of ownership or rights notices where applicable.

Vendor Listing Content

Vendors are responsible for ensuring they have the necessary rights or permissions for content submitted through their marketplace account.

  • Product photographs.
  • Product descriptions.
  • Brand names and trademarks.
  • Logos and packaging images.
  • Videos, graphics and promotional material.

Vendor Responsibility

A vendor must not knowingly upload, advertise or sell products or content that unlawfully infringes another party's copyright, trademark, design or other intellectual property rights.

Vendors remain responsible for the legality and authorization of products and listing material supplied through their accounts.

Counterfeit Products

Counterfeit products are prohibited on Omnity Center. Vendors must not knowingly list products bearing unauthorized trademarks, copied branding or other misleading indicators of authenticity.

  • Fake branded products must not be represented as genuine.
  • Unauthorized replicas must not be described as original products.
  • Brand labels must not be used to deliberately mislead customers.
  • Product authenticity information must not be intentionally falsified.
Suspected counterfeit or materially infringing listings may be restricted or removed while the matter is reviewed.

Third-Party Trademarks

Brand names and trademarks belonging to manufacturers, vendors or other third parties remain the property of their respective rights holders.

Their appearance on the marketplace does not by itself mean that Omnity Center owns those trademarks.

Product Images

Vendors should use images they own, are authorized to use, or are otherwise legally entitled to display.

Images copied from manufacturers, photographers, competitors or other websites may be subject to intellectual property rights.

Product Descriptions

Vendors should provide original or properly authorized product descriptions and must not deliberately copy protected content where such copying would violate applicable rights.

Customer Content

Where customers submit reviews, images or other content, they should submit only material they are legally permitted to share.

Users should not upload content that knowingly violates another person's intellectual property rights.

Reporting Intellectual Property Infringement

A rights holder or authorized representative who believes content or a product listing on Omnity Center infringes intellectual property rights may submit a complaint for review.

Please provide sufficient information to identify the issue:

  • Name and contact details of the complainant.
  • Identification of the intellectual property right concerned.
  • Identification or URL of the product/listing being reported.
  • Description of the alleged infringement.
  • Evidence of ownership or authority where reasonably required.
  • Relevant registration or supporting information, where applicable.
  • A statement that the information supplied is accurate to the best of the complainant's knowledge.

Review of Complaints

Omnity Center may review the information provided and may request additional documentation before taking action.

Where appropriate, relevant information may be requested from the vendor whose listing has been reported.

Listing Restriction or Removal

Where reasonably appropriate based on available information, Omnity Center may restrict, disable or remove content or listings associated with a suspected infringement.

Additional marketplace action may be taken for serious or repeated violations in accordance with applicable policies and agreements.

Vendor Response

A vendor whose listing is restricted may be asked to provide evidence showing that the product or content is genuine, authorized or otherwise legally permitted.

Failure to provide reasonable supporting information may affect restoration of the listing or marketplace access.

Repeat Violations

Repeated or serious intellectual property violations may result in listing restrictions, marketplace account suspension or termination, subject to applicable policies and law.

False or Misleading Complaints

Intellectual property reporting channels should be used responsibly. Users should not knowingly submit fraudulent, fabricated or materially misleading infringement complaints.

Marketplace Role

Omnity Center operates a multi-vendor marketplace where products may be listed and supplied by independent vendors.

Vendors remain responsible for ensuring that their products and listing content comply with applicable intellectual property requirements.

Policy Updates

Omnity Center may update this Intellectual Property Policy to reflect changes in marketplace operations, legal requirements or intellectual property protection practices.

The latest published version will apply from its effective date, subject to applicable law.
